An insurance company has been asked to pay an amount of AED 7,00,000 (Seven Hundred Thousand Dirham) to Peter Kolamala Babu (37) from Kottayam district of Kerala who suffered permanent physical & mental disability following a road traffic accident in May 2017.
The vehicle of a Pakistani citizen hit Indian citizen Peter Kolamala Babu who was moving to cross the road at Al Musalla Street in Sharjah. Peter was first taken to Al Qasimi Hospital Sharjah, and later shifted to Kerala for further treatment. The Sharjah Traffic Criminal Court found the Pakistani driver guilty and suspended his driving license for four months and ordered to pay an amount of AED 3000 as fine.
Later, the father, native and friends of Peter approached Salam Pappinissery, a legal representative of Ali Ibrahim Advocates & Legal consultants to file compensation case at the Dubai civil court against the driver and vehicle insurance company. The lawyer for Peter pleaded that, the accident was by the negligence of the driver and he has suffered severe skull and face injuries and he become unconscious by this accident and he suffered financial loss as well as physical and mental disabilities.
The lawyer represented for insurance company argued that, the details in the medical report are forged and the petitioner has not suffered such injuries mentioned in the medical report, and prayed to reject the claim of the petitioner. Having heard arguments of both side, the Dubai court of first instance found that the medical report and details contained are true, the insurance company is liable to compensate the petitioner and by rejecting the pleadings of the insurance company, concerning the mental, physical, and financial losses of the petitioner the court awarded compensation an amount of AED 7, 00,000 to the petitioner. Legal representative Salam Pappinissery said “We have approached the Dubai court of appeal to raise the compensation amount.”
